Subject: PokerStars paid me twice!!
I was part of the group of people whose echecks from 12-10-08 were
never received in my bank account. it was for $1,900.

Eventually, in early January they returned the funds to my stars
account and I took a check withdrawal. Check came and I cashed it.

Then, a couple of days ago it hit my bank account!

Has this happened to anyone else? I took the $1,900 out of my account
yesterday. What can stars do? What will they likely do?

FWIW, i am not going to email them about the issue. FK them.

They can take it from the person you dumped it to. I beat Neteller for
close to 100K and they had no recourse. I even posted it on RGP and
Neteller called me within 20 minutes. Told them to do whatever they
deem they must do.

The best way to screw the sites is the following way. Get your Insta
Check or whatever raised as often as you can. Since I played many
accounts and fairly large games, I had my limits raised to 10Ks 15ks
and even 25ks on my own name account.

Start playing on a Friday with a very small balance in your account.
Play for enough to make it worth while if you win. Cash games. If you
win, make sure the checks clear and cash the money out and keep doing
it until you lose. Then go and use another account and do the same. If
you lose, go to the bank, state fraud and close your account. No
bounced check charges and the bank won't even ask.

Losing the money to another player is something they will look at
right away. Even if a check is issued, they can stop payment.

Obviously, they COULD sue. But it wouldn't last long, as you'd
immediately contact the feds about any court appearance at which a
representative of the company was required to show up in court. You
would vigorously oppose any attempt by them to appear telephonically,
and make sure the court knew why. Then if they were stupid enough to
show up, they'd probably leave in handcuffs straight to a federal
detention facility, with no bail because they'd be an obvious flight
risk.

Most double pays aren't worth the bother of suing even if they didn't
have that problem.

It's not legal to defraud even a fraudster or criminal. It's just
that in most of the situations where you do, it's not practical for
the victim to go to the cops. What are they going to say? "That
criminal stole the money I stole fair and square!" "That guy ripped
me off on a smack deal!"

Also, the odds of the feds giving a shit or lifting a finger to bust
someone who ripped off an overseas gambling site are pretty much nil.
You just have to live with being a scumbag.

If a crook ripped off an actual bank, by comparison, you could expect
to do serious time. The lesson here is crooks must be very careful
they know exactly who they're ripping off and whether or not the
victims can do anything about it, at least if they don't like prison.

Not saying it's ethical for you to keep, because it is not, but
Pstar's only recourse is civil. Once they accidentally transfer those
funds to a valid account, they are stuck if the account is closed.
However, with the authorization to originally withdraw funds, then
transfer funds back, they are perfectly within their right to reverse
the transfer at any time. This is a little known liability that all
of us have when we give our bank account out to a bank, insurance
company, etc, to auto draft. There are few rules that govern
authorized EFT's to and from bank accounts, and it is taken advantage
of often by merchants and collectors. Do you really believe it's
soley a "security precaution" for them to only transfer funds to a
payment method that has been used to load funds with?... Not hardly.
I have run a finance company for many years, so believe me, I know...

You agree that the bank has recourse, though?

OK, how about this case, your employer makes a double-deposit by
mistake to your account (this has happened to me) and then reverses
the deposit a few days later. In the meantime you have closed the
account. You don't think the parties involved have recourse???

The _bank_ doesn't, as they are not the ones who have been screwed. The
deposit was real, not a forged cheque. If you withdraw, the bank has no
recourse, nor needs recourse against you. The original depositor to your
account may, depending on the circumstances of the transfer.

My recollection is that the deposit he got from PS was verifiably
valid, and not some bogus check.

PS would have to say to his bank that "oops, we didn't really, really
mean to make that deposit".
"Could you please send it back?".

Since the 70's when people wrote out "counter checks" in California
lo-ball rooms .. they were never able to collect in court

would trigger an examination of the previous activities . You simply go

Mr. Bennett, I believe you should go to the nearest police station to turn
yourself in, and plead guilty to fraud on your first court appearance.

Likely they will realize the error and reverse the deposit
to your bank account. Then your bank will start hitting
